I think the Bench being able to break ties eliminates that need though, plus, we will rarely have a tie.

Personally I think that should apply to all issues except in the case where a clarification is being made on something that is ambiguous (so the prior state is unclear). However, unfortunately, the motion to passed to allow the bench to break tied votes so now that is probably out the door.
