It can prevent the player from breaking the rules. The idea of punishment is not to try to find players making a mistake. It is to teach them not to break the rules.

The idea the Mods being able to be seen is a great idea. First, I wouldn't want to be playing why wary of someone watching me. The players themselves can report me if needed.

In order to appropriatly warn someone and ''teach'' them not to break the rules, you must first witness the offenses.
